Fragen vom jüngsten Compliance Netzwerkevent, zu dem LexisNexis gemeinsam mit dem Wirtschaftsprüfungs- und Steuerberatungsunternehmen PwC einlud.","pagecontent":"<p> Rund 130 Mitglieder des Compliance Netzwerk Österreich begrüßten PwC-Senior Partner Aslan Milla und LexisNexis-Verlagsleiterin Gerit Kandutsch letzten Donnerstag in der PwC-Zentrale in Wien Erdberg. </p> \n<p> Auf dem Veranstaltungsprogramm stand zunächst eine Kurzpräsentation der brandneuen PwC-Studie „IKS und Compliance Management in österreichischen Unternehmen“ durch die Autoren Barbara Redlein und Jörg Busch, der bei PwC u.a. die Compliance-Beratung verantwortet. </p> \n<p> Es folgte der Hauptteil zum Thema „HR &amp; Compliance“. Dazu trugen zwei internationale Expertinnen vor, die jeweils über praktische Expertise in beiden Ressorts verfügen. Die aus Polen stammende Malgorzata B. Borowa war viele Jahre Compliance-Verantwortliche bei Kabel Deutschland. Tamara Valenčič verantwortet bei Si.Mobil – dies ist die slowenische Telekom Austria-Tochter – sowohl die Personalagenden als auch Unternehmenskommunikation und Compliance. </p> \n<p> Anschließend wurde der in Gründung befindliche Österreichische Compliance Officer Verband, kurz ÖCOV, erstmals öffentlich vorgestellt. Zwei der Initiatoren, Armin Toifl, General Counsel Siemens Österreich, und Roman Sartor, Compliance-Verantwortlicher ABB, luden zur aktiven Teilnahme im Verband ein. Der Verlag LexisNexis bzw. das Compliance Netzwerk Österreich unterstützen den neuen Interessensverband. <i>Compliance Praxis</i>&nbsp;ist offizielles Publikationsorgan des ÖCOV. </p> \n<h2>HR &amp; Compliance: Kooperation auf vielen Ebenen</h2> \n<p> </p> <figure class=\"float-left \" style=\"max-width: 25%\" title=\"© Foto: Martina Draper\">\n <img src=\"https://www.compliance-praxis.at/GenticsImageStore/300/auto/prop/Allgemeines/Borowa.jpg\" class=\"img-fluid\" alt=\"Malgorzata B. Borowa (links im Bild) beleuchtete in Ihrem Referat die „Rolle von HR bei der Implementierung eines CMS im Unternehmen“. Human Resources ist bekanntlich als die „Summe personeller Gestaltungsmerkmale zur Verwirklichung der Unternehmensziele“ definiert. Da auch Compliance zu den Unternehmenszielen zu rechnen ist, liege eine Kooperation zwischen den beiden Bereichen auf der Hand, stellte Borowa fest. \n \n<p> Grundsätzlich seien zwei Haltungen der Personalverantwortlichen gegenüber ihren Kollegen von der Compliance-Abteilung zu beobachten: Abwehr oder Unterstützung. Mit beiden Ansätzen war die Vortragende in der Praxis bereits konfrontiert. Häufiger traf sie jedoch aktive Beteiligung an, wobei sich diese sowohl präventiv als reaktiv manifestieren kann. </p> \n<p> Präventiv kann sich HR etwa bei der Auswahl der Mitarbeiter einbringen: Schon in der Stellenbeschreibung lassen sich Elemente aus dem Compliance-Programm aufnehmen. Im Recruiting-Prozess kann HR einen Integritätscheck potenzieller Kandidaten vornehmen. Bei der Neueinstellung übernimmt die Personalabteilung schließlich die wichtige Rolle, über die ethischen Grundsätze des Unternehmens aufzuklären und in der Folge für Compliance-Fragen zu sensibilisieren. Reaktiv haben Personaler die Aufgabe, Sanktionen gegen Mitarbeiter zu vollziehen. Borowa sieht bei Sanktionen übrigens in erster Linie HR in der Pflicht, da sie Compliance im Kern als Instrument der Prävention und nicht der Reaktion versteht. </p> \n<p> Auch bei der Auswahl und der Beratung neuer Compliance-Verantwortlicher wird die HR-Abteilung idealerweise mit einbezogen. Einen neu eingestellten Compliance Officer kann&nbsp;sie beispielsweise dabei unterstützen, in Kontakt mit verschiedenen Mitarbeiterkreisen, mit Schlüssel-Abteilungen und mit dem Betriebsrat zu kommen. </p> \n<p> Kurz, HR habe bei der Konzeption, Implementierung und Anwendung von Compliance zentrale Aufgaben zu erfüllen. Als wünschenswert erachtete die Vortragende die Verknüpfung variabler Vergütungsbestandteile mit definierten Compliance-Zielen. Allerdings, so schränkte Malgorzata B. Borowa ein, sei dies nur in Unternehmen mit einem sehr hohen Compliance-Reifegrad vorstellbar und nur dann, wenn messbare Compliance-Ziele definiert und auch erreichbar sind. </p> \n<h2>Emotionen als Schlüssel zum Erfolg</h2> \n<p> </p> <figure class=\"float-left \" style=\"max-width: 25%\" title=\"© Foto: Martina Draper\">\n <img src=\"https://www.compliance-praxis.at/GenticsImageStore/300/auto/prop/Allgemeines/Valencic.jpg.jpg\" class=\"img-fluid\" alt=\"Tamara Valenčič, © Foto: Martina Draper\">\n <figcaption >Tamara Valenčič</figcaption> </figure>\n\n Tamara Valenčič leitet bei Si.Mobil, dem zweitgrößten Mobilfunkanbieter Sloweniens, sowohl Personal und Unternehmenskommunikation als auch Compliance. Valenčič hat die Erfahrung gemacht, dass bei der Implementierung einer Compliance-Struktur vor allem Emotionen über Erfolg oder Misserfolg entscheiden. Emotionen wie Vertrauen, Ärger, Scham, Angst, Überraschung. \n \n<p> So habe die Einführung einer neuen Corporate Culture bei Si.Mobil, die ganz auf Integrität setzt, viele Mitarbeiter zunächst einmal erleichtert aufatmen lassen. Endlich konnten sie klar argumentieren, weshalb sie bestimmte Angebote und Begehrlichkeiten vonseiten Dritter strikt ablehnten. Si.Mobil entschied sich etwa dafür, aufwändigen Vertriebspartner-Events fernzubleiben. Das löste bei den Marktteilnehmern einerseits Verwunderung aus, brachte andererseits Sympathiepunkte ein und hob den jungen Mobilfunker insbesondere positiv vom mehrheitlich staatlichen Marktführer Telecom Slovenije ab. Nachdem Valenčičs Team klare Regeln in Bezug auf Interessenskonflikte erlassen hatte, meldeten sich viele Mitarbeiter von sich aus, um ihre privaten Geschäfte zu melden. Das habe den positiven Nebeneffekt gehabt, dass das Unternehmen erstmals von den kreativen Potenzialen in der Belegschaft erfahren habe, so Valenčič. </p> \n<p> Wie ihre Vorrednerin zeigte sich auch die Referentin aus Ljubljana von den vielen Berührungspunkten und Möglichkeiten der Zusammenarbeit zwischen Compliance und HR überzeugt und hob drei Schlüsselpunkte hervor: </p> \n<p> \n </p><ul><li><p> <i>Integrity Checks:</i>&nbsp;Beim Überprüfen potenzieller künftiger Angestellter reicht es nicht, das polizeiliche Führungszeugnis zu studieren und auf Karriereplattformen oder in sozialen Netzwerken zu recherchieren. Ohne die Unterstützung erfahrener Personaler in den Einstellungsgesprächen bleibt jeder Integritätscheck unvollständig. </p></li><li><p> <i>Talent Management und Development:</i>&nbsp;High Performer in Unternehmen fungieren sehr oft als natürliche Vorbilder für die gesamte Belegschaft. Diese Spitzenkräfte sollten daher auch besonders integer agieren und sollten nach Kräften von Compliance und HR darin unterstützt werden, dies tatsächlich tun zu können. </p></li><li><p> <i>Performance Management:</i>&nbsp;Geht es um die Frage nach der Leistungsbeurteilung, darf nicht nur nach dem was, sondern muss auch nach dem wie gefragt werden. Was der Vortragenden hier noch fehlt: Ein Malus für unethisches Verhalten. Das sei jedoch aus gesetzlichen Gründen nicht möglich. </p></li></ul> \n<p> Valenčič zeigte sich abschließend überzeugt, dass der Erfolg von Si.Mobil, insbesondere bei einer jungen Zielgruppe, wesentlich auch dem sauberen Image des Unternehmens zu verdanken ist. Um dieses nachhaltig zu verankern, müssen Compliance und HR-Abteilung gemeinsam Hand in Hand arbeiten. </p> <div class=\"text-stoerer\">\n\t\t<div class=\"w-100 card-body\">\n\t\t\t<h2
